REGULAR MEETING OF TUESDAY, APRIL 23, 2013
1. Call to Order.
Chairman Johnson called the meeting to order at 7:00 P.M.
2. Roll Call.
COMMISSION MEMBERS PRESENT: Chairman Johnson, Vice Chairman Quihuis, Commissioner Burrell, Commissioner Behrends, Commissioner Berry, Commissioner Bishop, Commissioner Houston-Robertson.
COMMISSION MEMBERS ABSENT: None.
STAFF MEMBERS PRESENT: Justen Tregaskes, Planning and Zoning Director; Morgan Brown, City Attorney; Katie B. Fechtelkotter, Planner; Marian Agan, Administrative Assistant.

A. Consideration of Conditional Use Permit 602-04-156 submitted by Michael J. Curley of Earl, Curley & Lagarde P.C. on behalf of Green Hills Patient Center Inc. to allow for a medical marijuana dispensary on property located at 3191 S. White Mountain Road, that being A.P.N. 210-33-048B
COMMISSIONER BISHOP MOVED TO APPROVE CONDITIONAL USE PERMIT 602-04-156 SUBMITTED BY MICHAEL J. CURLEY OF EARL, CURLEY & LAGARDE P.C. ON BEHALF OF GREEN HILLS PATIENT CENTER INC. TO ALLOW FOR A MEDICAL MARIJUANA DISPENSARY ON PROPERTY LOCATED AT 3191 S. WHITE MOUNTAIN ROAD, THAT BEING A.P.N. 210-33-048B SUBJECT TO STAFF RECOMMENDATIONS.
COMMISSIONER BISHOP AMENDED HIS MOTION TO INCLUDE SIGNAGE TO ONLY DISPLAY THE FACILITY NAME, WITH THE HOURS OF OPERATION BEING SEVEN DAYS A WEEK FROM 9:00 A.M. TO 6:00 P.M. SECONDED BY COMMISSIONER HOUSTON-ROBERTSON; PASSED 5 TO 2, WITH COMMISSIONER BURRELL AND COMMISSIONER BERRY CASTING THE DISSENTING VOTES.
8. Call to Public.
Any citizen desiring to speak on a matter that is within the jurisdiction of the Planning and Zoning Commission may do so at this time. Comments may be limited to three minutes per person and shall be addressed to the Planning and Zoning Commission as a whole, and not to any individual member. Issues raised shall be limited to those within the jurisdiction of the Planning and Zoning Commission. Pursuant to the Arizona Open Meeting Law, the Planning and Zoning Commission cannot discuss or act on items presented at this time. At the conclusion of the call to the public, individual Planning and Zoning Commission members may (1) respond to criticism made by those who have spoken, (2) ask staff to review a matter, and (3) ask that a matter be put on a future agenda.

VICE CHAIRMAN QUIHUIS MOVED TO APPROVE THE MINUTES OF THE REGULAR MEETING OF MARCH 12, 2013, SECONDED BY COMMISSIONER BEHRENDS; PASSED 6 TO 0 WITH COMMISSIONER BISHOP ABSTAINING.
