REGULAR MEETING OF TUESDAY, MAY 28, 2013
1. Call to Order.
Chairman Johnson called the meeting to order at 7:00 P.M.
2. Roll Call.
COMMISSION MEMBERS PRESENT: Chairman Johnson, Vice Chairman Quihuis, Commissioner Burrell, Commissioner Behrends, Commissioner Berry, Commissioner Houston-Robertson.
COMMISSION MEMBERS ABSENT: Commissioner Bishop.
STAFF MEMBERS PRESENT: Justen Tregaskes, Planning and Zoning Director; Morgan Brown, City Attorney; Katie B. Fechtelkotter, Planner; Marian Agan, Administrative Assistant.
PUBLIC PRESENT: James Raymond, Debra Raymond, Larry Whipple, Mike Lewis, Chelsie Lewis, Ginny Lewis and others.

A. Consideration of Conditional Use Permit 602-04-158 submitted by James Raymond to allow a liquor store with drive through on property located at 4018 S. White Mountain Road, Suite E, that being A.P.N. 212-04-136A.
CHAIRMAN JOHNSON MOVED TO APPROVE CONDITIONAL USE PERMIT 602-04-158 SUBMITTED BY JAMES RAYMOND TO ALLOW A LIQUOR STORE WITH NO DRIVE THROUGH ON PROPERTY LOCATED AT 4018 S. WHITE MOUNTAIN ROAD, THAT BEING A.P.N. 212-04-136A SUBJECT TO STAFF RECOMMENDATIONS INCLUDING, IF THE LIQUOR APPLICATION IS APPROVED, ADMITTANCE TO THE STORE BE LIMITED TO THE AGE OF 18 YEARS AND OLDER, AND SECURITY BARS CURRENTLY ON THE EXTERIOR OF THE WINDOWS BE MOVED TO THE INTERIOR. SECONDED BY COMMISSIONER HOUSTON-ROBERTSON; PASSED 5 TO 1, WITH VICE CHAIR QUIHUIS CASTING THE DISSENTING VOTE.
8. Call to Public.
Any citizen desiring to speak on a matter that is within the jurisdiction of the Planning and Zoning Commission may do so at this time. Comments may be limited to three minutes per person and shall be addressed to the Planning and Zoning Commission as a whole, and not to any individual member. Issues raised shall be limited to those within the jurisdiction of the Planning and Zoning Commission. Pursuant to the Arizona Open Meeting Law, the Planning and Zoning Commission cannot discuss or act on items presented at this time. At the conclusion of the call to the public, individual Planning and Zoning Commission members may (1) respond to criticism made by those who have spoken, (2) ask staff to review a matter, and (3) ask that a matter be put on a future agenda.

COMMISSIONER HOUSTON-ROBERTSON MOVED TO APPROVE THE MINUTES OF THE REGULAR MEETING OF APRIL 23, 2013, THE MINUTES OF THE STUDY SESSION OF APRIL 23, 2013 AND THE MINUTES OF THE STUDY SESSION OF MAY 14, 2013, SECONDED BY VICE CHAIR QUIHUIS; PASSED UNANIMOUSLY.
